Legal Battle Intensifies in Maharashtra Politics Over Shiv Sena MPs
 

Maharashtra's Political Landscape Faces Legal Challenges

The political scene in Maharashtra is witnessing a renewed legal confrontation. The Shiv Sena (UBT), under the leadership of Uddhav Thackeray, has issued a stern legal notice to six of its rebel Lok Sabha members. The party firmly asserts that a merger with the opposing Shinde faction is not legally feasible. In response, Chief Minister Eknath Shinde dismissed the opposition's actions as entirely ineffective.


Arvind Sawant, the leader of the Shiv Sena (UBT) parliamentary group, reminded the six MPs in letters dated July 13 that they had won the 2024 Lok Sabha elections under Uddhav Thackeray's leadership and on the party's election symbol, opposing the Shinde faction.


Sawant emphasized that the original political party has neither initiated nor permitted any merger with Eknath Shinde's Shiv Sena. Citing paragraph 4 of the Tenth Schedule of the Constitution (Anti-Defection Law), he clarified that if there is no merger of the original political party, the question of merging the legislative party within the assembly does not arise, and there is no provision for it in the law.


He further noted that the party has received information about the rebel MPs claiming a merger through public channels and contacting Lok Sabha Speaker Om Birla. He made it clear that the party president has already been informed not to recognize any merger or separate group involving these MPs, and the president has yet to issue any such order.


Meanwhile, most of the rebel MPs have refrained from commenting on the notice, stating that Chief Minister Shinde has already responded on their behalf.
